Comments sought on lactation support policy

A campus-wide comment period will be held Aug. 19 – Sept. 22, 2013, for Policy 3.7, Lactation Support for Nursing Mothers.

Revisions to the Fair Labor Standards Act require employers to provide nursing mothers with a reasonable break time to express milk for one year after her child’s birth each time the employee has need to express breast milk; and a private space, other than a bathroom, that is shielded from view and free from intrusion of others, to express breast milk. Moreover, North Dakota Century Code allows employers to use the designation of “infant friendly” if the employer adopts a workplace breastfeeding policy. The University of North Dakota Lactation Support for Nursing Mothers policy is intended to satisfy federal and state requirements regarding the need for flexible time and space for breastfeeding mothers in the workplace.

This document has been reviewed by the Policy Advisory Group which includes representation from all vice president divisions and EERC.

The final policy document will take into consideration feedback received during the campus-wide comment period.

Policy Statement: The University of North Dakota aims to provide a supportive and flexible environment for employees as they transition back to work after maternity leave. The University provides reasonable time away from work for lactating mothers to express breast milk, and will make reasonable efforts to provide a private room or other location in proximity to work for such activity.

Reason for Policy: In compliance with Section 7(r) of the Fair Labor Standards Act and North Dakota Century Code (NDCC) 23-12-17, and in support of the institution’s Exceptional UND quality-of-life initiatives for faculty and staff, the University recognizes and respects the need to accommodate lactating mothers who choose to express breast milk during work time, without discrimination.
